Terms of Service

1. Acceptance of Terms

By accessing or using ResumeScribe.ai ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and AMK VA Services LLC ("Company", "we", "us", or "our").

2. Description of Service

ResumeScribe.ai is an AI-powered resume building platform that helps users create professional, ATS-optimised resumes. The Service includes resume templates, AI content generation, ATS scoring, cover letter generation, and related career tools.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activities that occur under your account
• Be at least 13 years of age to create an account

4. Subscription Plans and Billing

4.1 Plans

We offer three subscription tiers: Free, Pro, and Unlimited. Features and limits for each tier are described on our Pricing page.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed by Stripe. By subscribing, you authorise us to charge your payment method for the applicable subscription fees.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by law.

4.4 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Continued use after the price change takes effect constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorised access to any part of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to create resumes with fabricated credentials or false employment history
• Resell, redistribute, or sublicense the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service

6. Intellectual Property

6.1 Our Content

The Service, including its design, templates, code, and branding, is owned by AMK VA Services LLC and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content without permission.

6.2 Your Content

You retain ownership of the resume data and content you create using the Service. By using the Service, you grant us a limited licence to process and store your content solely to provide the Service to you.

7. AI-Generated Content

The Service uses AI to generate resume content, summaries, and suggestions. AI-generated content is provided as a starting point and may require review and editing. You are solely responsible for the accuracy and truthfulness of your final resume. We do not guarantee that AI-generated content will be suitable for your specific circumstances or that it will result in job placement.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE DO NOT GUARANTEE EMPLOYMENT OUTCOMES OR THAT YOUR RESUME WILL PASS ANY PARTICULAR ATS SYSTEM.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMK VA SERVICES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless AMK VA Services LLC and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
